Jax’s Law: new state legislation to combat counterfeit drugs resulting in deaths
Jax’s Law addresses California’s counterfeit drug epidemic through measures targeting the manufacture, distribution, and sale of counterfeit medications, particularly those containing lethal substances like fentanyl.
There are currently several US laws that in effect prohibit the sale and transport of counterfeit goods, including drugs. There is also supporting legislation which provides for specific penalties where injury or death is a result. We are looking for allies to help draft new California legislative code to specifically target this aspect of the illicit opioid trade, and believe that were it to be codified into law, it could have a substantial impact on the incidence of fentanyl deaths in California and elsewhere. For reference, we are considering the following US codes: https://www.law.cornell.edu/uscode/text/18/2320; https://www.law.cornell.edu/uscode/text/21/331. With the help of others we hope to 1) determine any precedent that might already exist in another state, 2) borrow lessons from the track record of such law, 3) using existing data, provide projections on the effects such a law would have on related drug deaths current arrests, convictions and so on. Using the aforementioned milestone items, lobby to get the support to get our measure on a future ballot.
